When patients need documents notarized, it’s essential to ensure they have valid identification, that the document is fully completed, and that they are aware of what they are signing and doing so willingly, without coercion. The following information outlines key details to help understand the notarization process and how to best assist those in a hospital or medical facility setting with getting their documents notarized.
A passport, driver’s license, or government-issued non-driver identification card (current or expired within three years from the date of notarization) is required. Pictures on a phone or photocopies are not permitted—the physical ID must be presented for the Notary to verify identity and complete the notarization.
It is the signer’s responsibility to obtain or create the necessary documents. A Washington State Notary Public cannot draft or provide documents. The Notary Public’s role is to verify completeness to safeguard against fraud but not to assess accuracy, as doing so would constitute the unauthorized practice of law. Since Notaries are not attorneys, we cannot advise on what is best for your specific situation.
If a document requires witnesses, it is the responsibility of the signer or their family to obtain them. Any impartial person can serve as a witness. In my experience, facility staff typically do not serve as witnesses due to potential conflicts of interest. Notary-provided witnesses are available for an additional fee beyond the mobile notary service appointment fee.
The signer must be alert and aware, not under conservatorship, and without medical orders preventing them from signing legal documents. If a Notary determines the signer lacks awareness—such as inability to communicate, confusion, or reluctance to sign—the Notary has the right to stop the signing, even if no official medical order exists.
